Laws Regarding Transport of Disabled Children

The Individuals with Disabilities Education Act (IDEA) mandates that some children with disabilities receive transportation to and from school. School districts must decide eligibility for transportation on a case-by-case basis.
  1. Definition

    • IDEA states that transportation, as it relates to disabled children, includes getting to and from school, traveling between schools, and traveling within an actual school building. Specialized equipment such as lifts and ramps can are also covered by the term "transportation."

    Basis for Eligibility

    • Students with disabilities must receive transportation services if such services will benefit the child educationally. Disabled students must be given the same opportunities to get to and from school as their peers. School districts must take this into consideration, as well as the specific needs of the disabled, in determining eligibility.

    Individual Education Plan

    • A multi-disciplinary team in each school meets to discuss specific requirements for a disabled child deemed eligible for transportation services. The team must then record all determinations and recommendations in the child's Individual Education Plan.
