Expulsion Policies

Expulsion is a last resort for students with chronic behavior problems, according to the State Bar of Wisconsin. Laws dictate how expulsion should be handled by schools, and can differ for students in special education programs.
  1. Recourse

    • Any child being expelled is allowed a closed hearing for appeal, according to the State Bar of Wisconsin. This appeal may be taken all the way to the state superintendent of schools, should it be denied. Students may be represented by counsel in these hearings.

    Special Education

    • Special education students will be considered for placement in a different program before expulsion occurs, according to the State Bar of Wisconsin. These students may not be expelled if their misbehavior is a manifestation of their disability.

    Considerations

    • Laws for special education students change if drugs or weapons were involved in a case, or if the child is a danger to herself or others. Students in regular education programs will be checked for special education eligibility before expulsion.
