Read section 8 of the National Labor Relations Act to find out if your labor complaint falls under the jurisdiction of the NLRB. Download this document from the "Our Documents' site, a government site operated in collaboration with National History Day, the National Archives and Records Administration, and USA Freedom Corps.
Find your regional NLRB by using the "Find your Regional Office" link on the right side of the NLRB website. Visit the office to inquire if the action by your employer is an unfair labor practice. Ask the office for the NLRB Form 501 "Charge against Employer" to file the complaint.
Fill in the form by indicating the name of your employer, her contact information and address. In the next section in the form, indicate the nature of establishment of your workplace. For example, it could be a factory or law firm. Also detail the services that the establishment provides.
Write a statement of facts in the "Basis for Charges" area of the NLRB Form 501. Describe briefly the nature of the incident or complaint and avoid indulging in an extensive defense of the charges you are bringing forth. Refrain from providing the names of witnesses or their telephone numbers. Indicate your name and address and sign at the bottom end of the form.
Submit the NLRB Form 501 to your NLRB office. Wait for the complaint to be submitted to the NLRB agents who will gather evidence and forward this evidence to the regional director who determines the course of action to be taken.
