Homeschool Bylaws

The board of directors of a home school group writes the bylaws, which are the set of rules that the group will operate under. These groups support, in some way, the homeschooling community. They may be co-ops, music groups or sports groups. Some states require non-profit groups such as these to have written bylaws.
  1. General Group Information

    • The first section of the bylaws should cover general group information. This includes the name of the group, its location and its purpose. The location is the general location of the group. Do not be too specific, because the location may change. Include the county and state that the group will be operating in. A home school support group is organized as a non-profit educational group under the IRS tax code and the purpose of the group must fit with this classification. A purpose might be to give the home school students the opportunity to participate in music or sports.

    Board of Directors and Other Officers

    • Each home school group should have a board of directors. This section of the bylaws should include how many members the board must have. It should state the responsibility of the board, whether it is to make all decisions for the group or to designate responsibility to members or other officers. The length of a term and the number of terms a board member can serve, as well as the frequency of meetings should be included. Other officers in the group could include a treasurer or secretary as well as the president and vice president of the board. The responsibility of these officers should be listed in the bylaws.

    Membership, Committees and Meetings

    • The bylaws of a home school group should include membership requirements. Possible requirements could be paying dues, agreement with a religious belief or willingness to follow certain homeschooling rules. The membership section should also include the right to vote, if applicable. The frequency of meetings of the entire group and the ability to call a special meeting of the group should be defined in the bylaws. The bylaws should also define the method of notifying members of a meeting. Committees may be defined in the bylaws or authority to create them should be given to the board of directors.

    Provisions

    • Other provisions that should be included in the bylaws include the ability to amend the bylaws and tax information. Since home school groups are non-profit educational groups, they must meet the criteria required by the Internal Revenue Code section 501(c)(3). The bylaws should state that the group may not act in a way contrary to this code, or the group may lose their non-profit status.
