Terminate and change the lease agreement if you share a lease. Write the landlord a request to change the lease agreement, or notify the landlord of your desire to terminate, according to the terms of the lease. Explain why you want to terminate and change the lease with your girlfriend excluded from it.
Write the girlfriend a letter stating the amount of time she has to leave the home, if there is no lease sharing. Write a professional letter with your address on it and using clear language asking her to move out.
Issue her with a three-day notice if she fails to vacate within the period of time that you had requested in the letter. Download copies of three-day notice forms from online sites such as Rental Housing Online, or obtain these copies from the local county court. Fill in the form by including her name, your name, the address, phone number, date and signature. Serve her with the notice.
Prepare a complaint for eviction if she refuses to move out within the three days. Write in the complaint for eviction why you want to evict her and the steps that you want the court to take. Attach a copy of the letter and three-day notice to the complaint, pay the filling fee and file these documents with the clerk and comptroller office or county court depending on your county's filing procedures. Ask the county court which of these two offices is appropriate for filing.
Obtain a summons from the clerk and comptroller or from the county court. Serve your girlfriend with the summons through the sheriff's office or through mailing or a process server.
Write a request asking the court for a hearing if your girlfriend responds to the summons. Forward the request to the clerk and comptroller's office or county court clerk. Alternatively call the court's office to request a hearing. Notify your girlfriend of the hearing date issued by the court, by writing to her.
File a motion for default by clerk if she fails to respond to the summons. Obtain these forms from the county clerk or clerk and comptroller's office and fill them in. The court will issue you with the final judgment for possession. Ask the court clerk or clerk and comptroller to prepare a writ of possession to enforce the judgment.
Pay the county clerk or clerk and comptroller the sheriff's fee by money order, check or cash. The office will forward the writ of possession to the sheriff who will then serve your girlfriend with a notice to voluntarily leave within 24 hours or be evicted by the sheriff's office.
