While Texas has no state statute on homeschooling, it is important for parents to know the laws concerning education and the right to home-school.
Article 7 Section 2 of the Texas Constitution authorizes the Texas Legislature to "establish and maintain public education," but does not authorize the Legislature to do so for private schools. In the court case Leeper vs. Arlington Independent School District, home schools were ruled to be private schools, and thus exempt from interference from the Legislature.
In the state of Texas, parents are not required to contact the school board of their intent to home-school, although parents are encouraged to do so in the case of withdrawing a child from public school. Parents who home-school are also not required to submit to home inspections/visits, be certified to teach, or have curriculum approved. The state may only inquire about the curriculum and standardized tests, though standardized tests are not required when homeschooling. Home-schools must keep a written curriculum and it must include reading, spelling, grammar, math and good citizenship.
