Contractors can seek relief from the Combined Instruction requirements from the procuring contracting officer (PCO) that issued the solicitation to purchase the supplies or services of interest (e.g., services, supplies, or construction). The PCO may relieve a contractor from the requirements if the PCO specifically determines the supplies or services provided have an established commercial marketplace.

Alternatively, the PCO can relieve a contractor from this requirement if the contracting activity enters into a commercial sales contract with a contractor as part of a Federal, State, or Local Government Bid Protest Act-covered transaction if the acquisition qualifies as a commercial item transaction pursuant to FAR Part 12, "Acquisition of Commercial Items."
